Why these letters matter

On 16 September 2024, my Ombudsman’s Final Decision accepted the Bank’s answer that arrears would still have arisen at the lower rate. Yet the question the Bank had been asked was “what impact would that have had on the level of arrears on the account present from time to time”. The Bank’s own reconstruction, using the Ombudsman’s limited correction, shows no arrears, or a credit, every day from 12 March 2014 to 21 April 2023.

This list is what was missing from the Service’s file up to that date, as far as I can tell. It may not be complete. Topaz’s disclosure has 80 wholly redacted pages. The Bank gives me a different set of documents each time I make a subject access request, and hundreds of the pages it disclosed in 2025 lack dates.

In the lead Davies case, the Ombudsman found that the four increases made between 2009 and 2012 were “not made for reasons permitted by the contract”. That is the Ombudsman’s decision, not my opinion: the contract did not allow them. Even on my Ombudsman’s 1.25-point reduction, if it had not been time-limited, my account would never have reached the three months’ arrears the Bank itself used as its trigger for litigation.

So why did I get so little back? Because the Bank told the Service that the restrictive covenant was a later, separate arrangement that was not there to protect me. I say it did that by giving my Ombudsman a false date for the transfer of my mortgage to MAS5, and a false account of how my mortgage was sourced. My case is simple: the covenant was there to protect me and my interest rate.

The Bank had also told investors that its non-core business, where my mortgage sat, was “targeted for run down or exit”. These letters need to be read in that light.

I say none of these letters was warranted. On the new facts, I ask the Service whether this treatment respected my rights under Article 8: respect for my home and my private life, which the European Court of Human Rights has held includes psychological integrity. Should the Service be upholding those rights?
